Policy on Digital Millennium Copyright Act

Greetings to our valued visitors of the website (referred to as the ‘Site’). As an entity, we hold utmost respect towards the rights of intellectual property, just as we anticipate the same level of respect towards our rights from others. In accordance with the regulations under the Digital Millennium Copyright Act, specifically Title 17 of the United States Code, Section 512(c), copyright owners and their representatives hold the ability to issue a takedown notice to us through our designated DMCA Agent, mentioned below. Being categorized as an internet service provider, we have the eligibility to claim immunity from any allegations of copyright infringement under the ‘safe harbor’ clauses of the DMCA. To issue a legitimate complaint regarding infringement, the following details must be included:

Notification of Infringement – Claim

  1. An actual or electronic signature of the copyright owner (or a designated individual authorized to act on their behalf).
  2. Specification of the copyrighted material that has allegedly been infringed upon.
  3. Description of the infringing content that needs to be removed, along with adequate information for the service provider to locate the material. [Kindly provide the URL of the concerned page to assist in identifying the supposedly offending material].
  4. Information adequate enough for the service provider to get in touch with the complainant, including name, physical address, email, phone number, and fax number.
  5. A statement indicating the sincere belief of the complainant that the usage of the material was unauthorized by the copyright agent.
  6. A statement affirming the accuracy of the details in the notification, with the understanding that any false information may lead to severe legal consequences.

Section 17 USC §512(f) enforces civil penalties, encompassing expenses and attorney fees, against individuals who intentionally provide incorrect information in an infringement notification under 17 USC §512(c)(3).

Kindly direct all notices of takedown via our Contact page, and preferably through email for expedited attention.

Please be informed that we may disclose the identity and details within any copyright infringement claim we receive to the supposed infringer. By submitting a claim, you acknowledge, consent, and agree that your identity and complaint may be shared with the alleged infringer.

Counter Notification – Material Restoration

In the event you have been served with a takedown notice due to a copyright infringement claim, you possess the option to deliver a counter notification to seek the restoration of the material in question on the site. Such a notification must be presented in writing to our DMCA Agent, containing the following elements as per 17 USC Section 512(g)(3):

  1. Your tangible or electronic signature.
  2. A depiction of the material that was removed and its original location before being taken down.
  3. A statement confirming under penalty of perjury that you genuinely believe the material was taken down or disabled as a result of an error or misidentification of the material intended to be removed or disabled.
  4. Your name, address, phone number, and an assertion indicating your consent to the jurisdiction of the federal district court located within your address (or alternatively, your consent to the jurisdiction of any judicial district where the service provider might be present), agreeing to accept the legal service process from the individual or organization who provided the initial infringement notification.

Forward your counter notice via our Contact page, with a strong recommendation for the use of email.

Policy Regarding Repeat Infringers

We handle cases of copyright infringement with utmost seriousness. As mandated by the guidelines of the Digital Millennium Copyright Act’s requirements for repeat infringers, we keep a record of DMCA notices from copyright holders and make sincere efforts to identify any individuals with repetitive infringement instances. Any individual found in violation of our internal policy on repeat infringement will face the termination of their accounts.
